MOTHER KILLED BY DELIVERY TRUCK SETTLES FOR $1.4 MILLION

A young mother was struck by a delivery truck on the highway and sustained a severe head injury. She was heliflighted to Vanderbilt Hospital where she passed away, leaving a young child. We met with the family at the hospital so we could begin working on the case immediately and get our investigators to the scene.

The delivery truck company denied liability and after two years of mediation with depositions and expert witnesses we recovered $1.4 million for our client’s family. We were able to set up a college fund for her child with lifetime income for her husband. While no amount of money can bring a loved one back, this resolution did provide closure for the family.

Should I file a lawsuit?

Car accidents happen all too frequently, and the numbers continue to grow each year. In fact, Logan County experienced a 17.8% increase in the number of car accidents between 2012-2016. Still, most accidents do not result in a lawsuit or trial and are instead settled out of court.

The last thing that many accident victims want to do is drag out the process or further complicate a traumatic experience. However, some situations require a lawsuit to recover the compensation needed after an accident.

When insurance companies fail to provide a reasonable level of compensation or if the accident results in severe injury or death, it may be necessary to take legal action.

Insurance companies may use various tactics to deny or reduce the value of an insurance claim to the lowest possible number. Without the skill and experience of a reputable law firm, it is easy for insurance companies to settle for far less than the true value of your case.

Taking advantage of our free case evaluation is the best way to determine if it is in your best interest to file a lawsuit. We also work on a contingency fee basis, meaning that we don’t get paid unless we win your case. Contact us today to discuss your legal options free of charge with our Logan County car accident lawyers.

Semi-Truck Accidents

There are many names for these large vehicles: big rigs, eighteen wheelers, tractor trailers, and semis to name a few. No matter what you call them, one thing holds true- big trucks cause big injuries. Negligence by the driver, the manufacturer, or the trucking company can be devastating for other cars on the road.

Every day, truck drivers are working long hours, often throughout the night and on strict deadlines. Furthermore, they are relying on those responsible for maintaining the vehicle to meet all safety requirements and keep the truck operating properly.

Any misstep along the way can be fatal for drivers on the road in Logan County and throughout Kentucky. In fact, between 2012-2016, there were 215 crashes involving semi-trucks in Logan County alone according to the KTC.

Why Should I Hire a Logan County Semi Truck Accident Lawyer?

If you have been injured by a semi-truck, speak with Flora Templeton Stuart personally to discuss your claim. Semi-truck accidents can be complicated, especially when there are multiple parties involved. We work hard for our clients to establish liability and work with the insurance companies to recover the maximum compensation you deserve.

Our Logan County injury attorneys have a proven track record in handling eighteen-wheeler accident claims and have recovered millions for our injured clients in Logan County. To find out how we can help with your claim, contact us for a free case evaluation today.

Motorcycle Accidents

Motorcycle and moped accidents are among the most serious cases we see and can be extremely costly. Many riders are left with significantly higher medical expenses due to the severity and types of injuries that are commonly found in motorcycle accidents. It is not unusual for accident victims to spend weeks or months in the hospital following a motorcycle crash, accruing sizable medical bills and lost wages.

Fortunately, our attorneys can file insurance claims or personal injury lawsuits to maximize your recovery. If you have been in a motorcycle crash, call our Logan County motorcycle accident lawyers today to discuss your options.

Common Motorcycle Crash Injuries

Due to the lack of safety measures in place to protect riders in the event of an accident, the injuries sustained after a motorcycle crash can be quite severe. Some of the common injuries found in motorcycle accidents are as follows:

As Logan County motorcycle crash lawyers, we are dedicated to seeking justice for our Logan County clients who have been injured in motorcycle accidents. We have over 45 years of experience investigating motor vehicle accidents and defending the rights of our injured clients. Personal Injury

As the third leading cause of death in the United States, accidental injuries happen frequently and often without warning. After an accident, many are left with the financial burden of mounting medical bills, pain & suffering, and lost wages. If you have been injured due to another party’s negligence in Logan County, our team is here to help.

How do I know if I have a personal injury case?

Various accidents and incidents can be the basis for a personal injury claim. Some of the most common personal injury cases we handle are:

Although these are all types of personal injuries, certain conditions must be met before taking legal action. The primary element of a personal injury claim is negligence and our job is to establish liability for the injury due to that negligence. To have a viable case, our Logan County injury lawyers must prove the four elements of negligence:

  1. Duty: The first element in proving negligence is to show that one party owed another party a duty, most commonly the duty of care. The duty of care is the legal duty for an individual, business, or other entity to act reasonably to avoid injury others. For example, drivers on the road have a duty to both their passengers and other drivers on the road to safely operate their vehicles.
  2. Breach: When one party does not behave in the way a reasonable person would under similar circumstances or behaves negligently, the duty of care has been breached. Acting in a certain manner or failing to act can both qualify as a breach of duty. A store employee who fails to put up adequate signage around a wet area and causes a person to fall is one example of a breach of duty.
  3. Cause: Once it is established that the plaintiff was owed a duty and that the defendant breached the duty, we must prove that the breach of duty of care directly resulted in the plaintiff’s injuries. For example, a pet owner who fails to leash their dog can be found negligent when the dog attacks and injures a nearby jogger.
  4. Damages: Lastly, there must be verifiable damages suffered by the plaintiff as a result of the defendant’s negligence. In this stage, both economic and non-economic damages are measured such as medical bills, lost income, and pain & suffering. For example, a construction worker who has lost $20,000 in wages after breaking his arm due to unsafe working conditions may pursue damages for loss of income.

By proving that one party had a duty to another and breached that duty resulting in physical harm, our Logan County injury lawyers can then submit a claim to recover damages from the negligent party.

How much can I get for my case?

While each case is different, determining how much you may be eligible to recover typically comes down to a few factors: the severity of your injuries, past and future medical expenses, and recovery time. The attorney you choose for representation can also dramatically influence the value of your case. By choosing our top-rated Logan County injury attorneys, you can rest easy knowing that we fight for maximum recovery for all of our clients.

The compensation for your claim is determined by the damages that can be recovered. Two types of damages that can be pursued in a personal injury claim are compensatory damages and general damages.

Compensatory damages, or economic damages, are the monetary losses caused by another party’s negligence. Medical expenses, physical therapy, lost wages or loss of earning capacity, and property damages fall into this category.

General damages, also known as non-economic damages, stem from the pain, suffering, and mental anguish endured after an accident. These damages have no monetary value assigned to them and are therefore more difficult to calculate, but include things such as loss of companionship, physical pain, loss of quality of life, and other intangibles.

For insurance companies, the goal is to reduce personal injury claims as much as possible or to deny them altogether. Our goal is to do the opposite- we fight the insurance companies to maximize the value of each case. With a success rate of over 90%, our team of experienced Logan County injury lawyers has recovered millions for our injured clients in Logan County.

Wrongful Death

The death of a loved one can be devastating, especially if it is caused by an accident, wrongful act, or the negligence of another. When a life is lost due to someone’s recklessness, it is important to contact a Logan County wrongful death lawyer who can help surviving families with their wrongful death claim.

Losing a loved one is hard enough without the financial and emotional burdens that disrupt the grieving process. Surviving family members can be left with hefty medical bills, loss of income or financial support, and various insurance & legal requirements that can be dragged out for weeks or even months. Our experienced Logan County wrongful death lawyers can expedite this process and maximize your recovery so you can focus on healing.

Common Types of Wrongful Death Cases

Vehicle accidents are the most common cause of death cited in wrongful death claims in Kentucky. Negligent drivers cause thousands of deaths on our roads and highways each year and can be held liable for the deaths of other drivers or passengers involved in the collision. Alternatively, workplace accidents, pedestrian accidents, and nursing home neglect are just a few of the other incidents where pursuing a wrongful death claim may be necessary.

When Insurance Pays In A Car Accident

Several types of insurance coverage that will pay if you’re injured in an automobile collision:

Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.

Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.

Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.

Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.

How We Prove Negligence in Your Auto Accident Case

Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:

Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.

Breach of duty: The at-fault party breached their duty of care, instead acting negligently.

Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.

Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.

Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.

Kentucky and Tennessee Car Accident Laws

Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.

Statute of Limitations in Kentucky and Tennessee

In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
