Personal Injury Testimonial
"Treated me as if I was family! Treated me as if I was family! ALWAYS very responsive and never made me feel as if I was just a number or a dollar sign. They went above & beyond & helped me with doctors even going to the trouble of setting up my doctors appointments! I would also like to point out that even after I had spoken to another lawyer that is very big on advertising told me that I didn’t have a case and flat refused to help me. Ms. Flora told me that I most certainly did and started working for me right then! I can’t say enough good things about this law firm! May God Bless and Protect Them & You All! Jeffery M.

Types of Personal Injuries

A personal injury case arises when one person is injured due to someone else’s negligence or intentional act. When this occurs, victims may be entitled to seek compensation for their injuries and losses from the at-fault party. Depending on the situation, the injured party may seek compensation for physical, financial, and/or emotional losses, also known as damages.

There are several events that can result in a personal injury lawsuit. How much money can I expect from a settlement in Bowling Green?

  • Liability–is the other person at fault?
  • Property damage in motor vehicle accidents
  • Extent of the injuries and medical treatment
  • The insurance company and the amount of insurance available
  • Representation by our experienced Bowling Green personal injury lawyers
At Flora Templeton Stuart Accident Injury Lawyers, we provide personal representation for maximum recovery.

What injuries are compensated in a Bowling Green injury lawsuit?

The objective of a personal injury lawsuit is to provide compensation for those who have been injured to the negligence of another. Therefore, any bodily injury that occurs as a direct result of the at-fault party’s wrongful conduct may be compensated via a personal injury claim. Compensation varies based on the type and severity of the injury. Neck and back injuries, such as whiplash, are some of the most common injuries we see in Bowling Green personal injury cases, including sprains or strains to muscles, ligaments, discs, and other soft tissues. Other injuries that may be compensated through a personal injury claim include:
  • broken bones
  • bruising
  • burns
  • head injuries
  • traumatic brain injuries
  • internal injuries
  • limb loss

What accidents are covered in a personal injury lawsuit in Bowling Green?

Personal injury cases can arise from a number of different scenarios, but not every injury will result in a valid personal injury claim. For an injured party to seek compensation through a personal injury claim, one party’s negligence must have directly caused injuries or damages of another. In Bowling Green, the most common injury cases involve car wrecks, semi-truck accidents, and other types of motor vehicle accidents. Other accidents covered in personal injury lawsuits include medical malpractice, wrongful death, premises liability, products liability, dog bites, workplace accidents, and any other kind of accident where one party causes injury to another.

When should I hire a Bowling Green personal injury attorney?

If you have been injured in an accident that was not your fault, you should immediately hire a Bowling Green personal injury lawyer. When Flora Templeton Stuart Accident Injury Lawyers are hired, we preserve the evidence, take photos, investigate the accident, and refer our clients to excellent physicians while reserving their PIP benefits to get their medical bills and lost wages paid. The sooner we get started, the more likely it is that we can obtain a good settlement.

How much should I ask for in a Bowling Green injury settlement case?

In a Bowling Green injury settlement, we always demand the most we can collect and often more than the case is valued to get the highest amount possible in negotiation. At Flora Templeton Stuart Accident Injury Lawyers, we often know the insurance adjusters so we can better negotiate the maximum settlement for our clients.

What percentage of settlement do lawyers take for personal injury cases?

In most cases, your personal injury attorney’s services are offered through a ‘contingency agreement’. Through this arrangement, clients pay nothing up front for the attorney’s legal services or other case costs. Instead, the attorney will work on your case for free until your case has concluded. When your case has been settled or damages have been awarded, your attorney is then entitled to a percentage of the total recovery. In short, you pay nothing unless we win your case. Personal injury attorneys who work on a contingency fee basis charge anywhere from 30-40% of the total recovery. For example, if you settle for $100,000 and your attorney charges a 40% contingency fee, you will receive $60,000 minus case costs and other expenses. At Flora Templeton Stuart Accident Injury Lawyers, we only take 35% of the total recovery for our services if the case does not go to court. If we do not successfully obtain compensation on your behalf, you owe us nothing.

How do I pay my Bowling Green attorney in a personal injury case?

The injuries you sustain following an accident are bad enough, but the financial burden of hiring a lawyer and fighting the insurance company can be even more stressful. At Flora Templeton Stuart Accident Injury Lawyers, we believe that everyone has a right to quality, caring legal representation. To best serve our clients, our Bowling Green personal injury attorneys provide their legal services on a contingency fee basis, meaning that you pay nothing unless we win. A contingency fee agreement helps to limit an accident victim’s financial obligations immediately following an accident. Through this arrangement, clients will never pay any up-front legal fees or case costs out of pocket. Instead, your attorney will handle your case free of charge until a settlement has been reached. At that time, a portion of the total amount recovered will be awarded to your attorney. Your lawyer will then write you a check for the remaining balance.

How long will my personal injury case take in or out of court to settle?

The amount of time a Bowling Green personal injury case takes to settle is based on various factors. These include the extent of the injury (length of treatment), amount of insurance to collect, and the attorney who is handling your case. At Flora Templeton Stuart Accident Injury Lawyers, the average time to complete your case from start to finish without going to court is around 4-6 months. If suit is filed, the case may settle at mediation within a year but if there is a trial it can take years. Most cases settle out of court and are resolved within six months at our law firm.

Do I have to go to a Bowling Green court in an injury case?

In the great majority of cases, you do not have to take your case to court. When liability is clear and you complete your medical treatment, the insurance company will negotiate a settlement with your attorney. The cases that go to court involve serious injury or death and substantial insurance to collect.

Do I really have to talk to an attorney about a personal injury claim?

While not all accidents require the assistance of a Bowling Green personal injury lawyer, we highly recommend speaking with one immediately after an accident. There are several elements of a personal injury claim that are extremely complicated. Without an attorney, the insurance company may pay only a fraction of what your case is worth. Only a skilled attorney with years of experience can determine whether litigation is necessary and fight for the settlement you deserve.

What can I expect when I hire Flora Templeton Stuart Accident Injury Lawyers

When you hire our Bowling Green personal injury lawyers, you will receive a dedicated team of attorneys who give personal representation to each client.

Will my Bowling Green personal injury case go to trial?

The great majority of personal injury cases rarely go to trial. In fact, in 2021, only two injury cases were tried in Warren Circuit Court. Most cases settle before trial at mediation. Generally, most cases with major damages are tried in court.
At Flora Templeton Stuart Accident Injury Lawyers, we are not a mega law firm so you get personal representation from top attorneys with years of experience representing the injured. Car accidents and other motor vehicle accidents are among the most common personal injury cases we see in Bowling Green. Every year, around 800 people in Warren County are injured in car accidents, according to the KTC. There are several different types of car accidents, but nearly all of them are caused by negligence on behalf of the at-fault driver. If you or a loved one has been seriously injured in a car accident, contact Flora Templeton Stuart Accident Injury Lawyers today. With over 46 years of experience and millions recovered for our clients, we can get you the compensation you deserve.

Our Bowling Green car accident lawyers represent victims in all types of car accidents, including drunk driver accidents, pedestrian accidents, rideshare accidents, bus accidents, and company vehicle accidents.

Semi-truck accidents are some of the most serious cases we handle at Flora Templeton Stuart Accident Injury Lawyers. Due to their weight and size, these large vehicles are difficult to maneuver and even more difficult to slow down. Aside from being more challenging to handle than passenger vehicles, major causes of semi-truck accidents include driver inattention, drugs and alcohol abuse, truck driver fatigue, and vehicle maintenance negligence. If you or a loved one has been seriously injured in a semi-truck accident, contact our experienced attorneys today.

Our Bowling Green truck accident lawyers represent truck accident victims injured in backing & loading accidents, rear-end truck accidents, U-turn accidents, rear & side crashes, blind spot & lane change accidents, unsafe driving accidents, and more.

According to the Kentucky Transportation Center, there were 80,248 registered motorcycles on Kentucky’s roads and highways in 2020. Although motorcycles make up less than 3% of all vehicles in Kentucky, they still have the same rights to the road as other motorists. Drivers who are not looking out for these small vehicles and cause an accident often walk away unscathed, but even the most minor collision can have devasting consequences to a biker.

At Flora Templeton Stuart Accident Injury Lawyers, our Bowling Green motorcycle accident lawyers understand the devastating injuries or fatalities that can occur when a rider is hit by a large car or truck. With over 46 years of experience and millions of dollars recovered for our biker clients, Bowling Green motorcyclists know they can turn to us when they are injured by a negligent driver. If you have been injured in a motorcycle accident or moped accident, contact the law firm that cares about you today.

Losing a family member can be a tragic experience, but the loss can be even more painful when the death was caused by the negligent or reckless behavior of another. At Flora Templeton Stuart Accident Injury Lawyers, we help the family of the deceased file a wrongful death claim against the at-fault party. This allows the surviving family members to recover compensation to help cope with the loss and deal with the unforeseen expenses that often occur after a death.

While nothing can bring back a loved one, a wrongful death lawsuit can provide compensation for a variety of losses resulting from the death, such as lost wages, loss of companionship, funeral expenses, or pain & suffering leading up the death. Our Bowling Green wrongful death attorneys have recovered millions for victim’s families in wrongful death lawsuits, including a $1.45 million settlement for the parents of child who was killed by a negligent driver. If you have lost a loved one due to the negligence of another, contact our skilled team today.

Premises liability cases involve an injury sustained on someone else’s property. Property owners, including business owners, lessees, and homeowners, have a legal duty to those lawfully visiting their premises to maintain their property in a safe condition. If a property owner fails to keep their premises safe and an injury occurs, the injured party may pursue compensation against the property owner.

This includes slips & falls, elevator accidents, fire accidents, swimming pool accidents, and other situations where a property owner failed to maintain the property or adequately warn guests of hazardous conditions. If you were injured on someone else’s property, contact our Bowling Green slip and fall lawyers to discuss your case.

Dog bites are a type of premises liability case where a negligent pet owner‘s behavior results in serious injury to another. Much like drivers or property owners, dog owners in Bowling Green have a certain responsibility to ensure that their pet does not attack or bite another person or animal.

Failing to leash or properly restrain an animal is one of the most common examples of negligence we see, however an owner whose dog has a history of aggression must take additional steps to ensure that they do not seriously injure anyone who may come into contact with the dog. If they do not and an injury occurs, they may be held liable for any damages sustain by the victim, including medical bills, emotional distress, and lost wages. Our Bowling Green dog bite lawyers have over 46 years of experience and can fight for the compensation you deserve.

Drunk driving accidents are often very serious, both in terms of the physical injuries and the financial burden resulting from the accident. Alcohol can slow reaction time, impair judgement and concentration, and blur vision; all of which are crucial to safely operating a large vehicle.

Although a driver who is intoxicated at the time of the collision is almost always at fault, it is not always as simple to recover adequate compensation as it should be. Those who carelessly risk their own lives and the lives of others should be held accountable for their actions, which is why our Bowling Green drunk driver accident lawyers help those injured by drunk drivers fight for fair compensation.

When it comes to motor vehicle accidents, no party is at a greater risk for serious injury than pedestrians and bicyclists. One minute you may be walking peacefully down the street and the next thing you know a 4,000+ pound vehicle sends you flying through the air. Drivers who disregard the right of way or are not looking out for others put pedestrians at risk for serious injury.

If you or a loved one has been injured in a pedestrian accident or bicycle accident, you have the right to hold the negligent driver responsible for the damages you sustain. Our Bowling Green pedestrian accident lawyers have a proven track record of success and can help you get the settlement you deserve.

If you have been injured through no fault of your own, contact a Bowling Green personal injury lawyer immediately. Our attorneys have over 46 years of experience holding the at-fault party accountable for the damages they cause. We will investigate the accident, get you the medical care you deserve, and negotiate with the insurance companies to get you a fair settlement.
