Should I hire an attorney if I have only minor injuries?

No matter how minor your injuries may seem it is important to contact an attorney right away. Certain injuries may have delayed symptoms or become worse over time. Whiplash, for example, is the most common injury in car accidents and may be suppressed for days or weeks after the initial collision. Without an attorney and proper documentation, it can be difficult to prove that the injuries sustained were caused be the accident. Not only will our team protect you from the insurance companies, but we will make sure that you get the best treatment for your injuries. We refer our clients to quality physicians to give you the best chance at a full recovery.

By offering a free case evaluation, car accident victims can feel at ease knowing that our Macon County car accident lawyers are here to provide guidance in your time of need. Even if hiring a lawyer isn’t the best option for you, Flora will personally review the details of your case and advise you on your next steps.

Semi-Truck Accidents

Semi-trucks are the largest vehicles on our roads and highways. Not only is their sheer size intimidating, but the average tractor trailer weighs over 80,000 pounds, or more than 16x the typical car. For this reason, accidents involving semi-trucks can easily cause severe injuries and fatalities. Also, the drivers are on the road for long hours and under strict deadlines making negligence and mistakes in this industry all too common. If you or a loved one was injured in an accident involving a semi-truck, contact our Macon County semi-truck accident lawyers today for a free case evaluation.

How much is my truck accident case worth?

Dealing with a semi-truck accident is completely different than dealing with a car accident for a few reasons. Not only are the injuries typically more severe in semi-truck accidents, but multiple parties could be liable for the damages, including the trucking company, driver, manufacturer, or cargo loader. Furthermore, each party is their own separate entity with different insurance coverages and policies. This can make it extremely difficult to determine who exactly is at fault and the extent of their responsibility in the accident.

While each case is unique, there are certain factors that determine the value of your case, including:

  • Severity of The Injuries
  • Total Medical Expenses
  • Lost Wages/Loss of Earning Capacity
  • Pain & Suffering
  • Property Damage

Without a completing thorough investigation of your case, it is difficult to estimate the true value of your claim. However, our Macon County semi-truck accident lawyers offer free case evaluations for our injured clients. Simply contact us at 888-650-4554 to speak with attorney Flora Stuart personally about your case.

Motorcycle Accidents

Motorcycle accidents are some of the most serious cases we see. Many riders are left with serious injuries and require long-term medical care as a result of the accident. Furthermore, Tennessee law can be complex and unforgiving to motorcycle accident victims. That is why it is so important to contact our Macon County motorcycle accident lawyers after a wreck. We will immediately get to work on your case and fight to get you the compensation you deserve for your injuries, lost wages, pain and suffering, and any other expenses resulting from the accident.

Determining Fault in Tennessee Motorcycle Accidents

In Tennessee, the at-fault driver is responsible for any injuries or other damages sustained in a motorcycle accident. However, there can be more than one driver who may bear varying degrees of responsibility for the accident. This is determined as a percentage of fault for the accident and is known as the modified comparative negligence system.

The modified comparative fault laws allow for a judge or jury to assign a percentage of fault for each party involved in the accident. For example, if a car changed lanes in front of your motorcycle and caused a crash, but you were speeding at the time of the collision, the police may determine that you were 20% at fault for the accident while the other driver contributed 80% to the accident. In this scenario, the total amount of compensation received could be reduced by 20% due to your percentage of fault in the accident. Therefore, if you were awarded $50,000 as compensation, you would only receive 20% of the total, leaving you with $40,000.

One exception to this rule is known as the 50 percent rule. Under this rule, accident victims may only collect damages if their percentage of fault for the accident is 49 percent or less. If they primarily responsibility for the accident, then they are not eligible to receive any damages for the accident.

Wrongful Death

In Tennessee, the survivors  of a person killed by the negligent, intentional, or reckless behavior of another are able to seek damages for the loss. This can be in the form of mental pain and suffering, medical expenses, loss of companionship, or loss of support and services. We know that no amount of money can bring back a loved one, however we believe in holding the responsible party accountable for their actions and providing some comfort to the grieving family. If you have lost a loved one due to someone else’s negligence, contact our experienced Macon County wrongful death lawyers. Attorney Flora Templeton Stuart will review your case personally and be by your side when you need her the most.

Common causes of wrongful deaths in Tennessee

Wrongful death claims are usually a result of some type of accident cause by the negligence of another. This can be a reckless driver, a negligent employer, or even a homeowner who fails to secure their pool. Some of the most common causes of wrongful death include:

  • Car accidents
  • Semi-Truck Accidents
  • Pedestrian and bicycle accidents
  • Workplace injuries
  • Unsafe commercial and residential premises
  • Preventable child deaths, accidental drowning

Regardless of the cause of the wrongful death, surviving family members have a right to be compensated for their loss. If your loved one died because of another person’s negligence, contact our Macon County wrongful death lawyers today for a free case evaluation.

When Insurance Pays In A Car Accident

Several types of insurance coverage that will pay if you’re injured in an automobile collision:

Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.

Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.

Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.

Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.

How We Prove Negligence in Your Auto Accident Case

Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:

Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.

Breach of duty: The at-fault party breached their duty of care, instead acting negligently.

Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.

Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.

Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.

Kentucky and Tennessee Car Accident Laws

Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.

Statute of Limitations in Kentucky and Tennessee

In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
