What is my case worth?

There are a variety of factors than will impact the amount of compensation that you can recover in a personal injury claim. Personal injuries can have serious financial, physical, and emotional burdens. The value of your case essentially hinges on the impact that these burdens have on your life and any financial losses incurred as a direct result of the accident. This includes the nature of your injuries, the type of medical treatment you receive, recovery time, and the long-term effects of the personal injury.

A personal injury lawsuit generally seeks economic and noneconomic compensation. Medical bills, loss of income, and property damage are economic damages, while pain & suffering and loss of consortium are noneconomic damages. While the level of compensation for your claim largely depends on the nature of your injuries or losses, an experienced law firm can negotiate with insurance companies to maximize your recovery. When it comes to personal injury claims, hiring the right law firm can be the difference between getting the compensation you need to recover and being left with substantial medical bills and other expenses. Call our Elkton personal injury lawyers today and put our 43 years of experience to work for you

Common Causes of Car Accidents

Most car accidents involve driver error or another method of unsafe driving. Some of the leading causes of car accidents include:

Distracted Driving: One of the most common negligent driving behaviors cited in accident reports is distracted driving, which is defined as any activity that takes a driver’s attention away from the road including eating or grooming. Texting is the most common of distracted driving, with the average driver spending over 3.5 minutes out of every hour behind the wheel on their phone.

Speeding: Speed limits are in place so that drivers have enough time to react and avoid collisions. A driver who fails to obey posted speed limits and traffic laws endanger themselves and everyone around them.

Driving Under the Influence: Driving under the influence of drugs or alcohol is both dangerous and irresponsible. Intoxicated drivers are unable to safely operate their vehicle due to delayed response times and altered perceptions.

Tailgating: Following too closely to a leading vehicle significantly reduces the amount of time to avoid a collision. If the driver has to use their breaks for any reason, the tailgater will almost always rear-end the vehicle in front of them.

Dangerous Road Conditions: Both state and local governments are required to maintain safe road conditions at all times. If a roadway left in disrepair causes an accident, the entity tasked with maintaining that stretch of road can be named in a personal injury claim.

If you have been involved in a car accident and suspect that the other driver engaged in any of these behaviors, contact our Elkton car accident lawyers today.

Semi Truck Accidents

Semi-trucks can cause catastrophic injury when they strike a vehicle or motorcycle due to their weight and size. While the average weight of passenger vehicles is around 4,000 pounds, tractor-trailers can weigh up to 80,000 pounds when fully loaded. Although the industry is highly regulated to promote safety, thousands of innocent drivers are seriously injured or killed by these big rigs every year. Between 2012-2016, Todd County alone had 91 accidents involving semi-trucks according to the KTC. Negligent semi-truck drivers put Kentucky drivers at serious risk, which is why our legal team is on standby to help our injured clients after an accident.

Motorcycle Accidents

Motorcycle accidents often result in severe injuries to riders and passengers. Walking away from an accident is rare and some riders are left with permanent damage. Riders are aware of these risks and do what they can to protect themselves on the roads. Sadly, motorcycle operators can only do so much to ensure their own safety, especially when negligent drivers fail to do their part.

With over 45 years of experience, our Elkton motorcycle accident lawyers understand these dangers better than anyone. We have successfully represented hundreds of motorcycle accident victims and their families in their time of need. Contact us today for a free case evaluation.

Wrongful Death

Many of the accidents that lead to fatalities could have been prevented if not for the carelessness or reckless behavior of another. When a loved one loses their life due to the negligence of another, the negligent party should be held accountable for their actions. Surviving families are often left with medical bills and funeral costs on top of the emotional loss that comes with the death of a loved one.

At Flora Templeton Stuart Accident Injury Lawyers, we believe that the responsible party should pay for these expenses so that the family can begin healing. Our Elkton wrongful death lawyers have fought for grieving families to seek justice and fair compensation for over 45 years. Contact our experienced team of wrongful death attorneys for a free case evaluation.

Todd County Car Accident Statistics

From 2021 to 2022, Todd saw increases in automobile related accidents, but drops in fatal accidents and a similar numbers of non-fatal injuries. The numbers show:

  • Total Accidents – 223 to 257
  • Fatal Accidents – 5 to 3
  • Non- Fatal Injuries – stayed at 49
  • Persons Killed – 7 to 3

These results show that driver safety in the car has increased, as fewer individuals are experiencing fatal crashes, but proper driver behavior on the roads could be improved. You can never be too safe, so make sure you engage in proper driving behaviors.

When Insurance Pays In A Car Accident

Several types of insurance coverage that will pay if you’re injured in an automobile collision:

Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.

Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.

Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.

Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.

How We Prove Negligence in Your Auto Accident Case

Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:

Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.

Breach of duty: The at-fault party breached their duty of care, instead acting negligently.

Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.

Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.

Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.

Kentucky and Tennessee Car Accident Laws

Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.

Statute of Limitations in Kentucky and Tennessee

In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
