Car Accidents

If you have suffered serious injuries in a Ohio County car accident that wasn’t your fault, your health should be your main concern. However, recovering from your injuries can take a backseat to the more practical matters at hand, such as paying for your medical bills or dealing with lost income as a result of the crash. At Flora Templeton Stuart Accident Injury Lawyers, our attorneys believe in handling all of the details so our clients can focus on healing.

Once you contact us, our Ohio County car accident lawyers will immediately begin investigating the accident to identify exactly what happened and who is to blame for the crash. We will gather evidence, negotiate with the insurance company, and work with crash experts to build the strongest case possible for our injured clients. You should never have to worry about the financial and legal burdens that a car accident can cause, especially when the wreck even wasn’t your fault. Our top priority is to help carry that burden and secure the compensation that you deserve for your injuries and losses.

Do I Have A Case?

After being injured in a car crash in Ohio County, you may be wondering whether or not to file a personal injury claim against the other driver. In order to be eligible to collect damages, your accident must meet two criteria:

First, the accident must have been caused, at least in part, by the negligent, reckless, or careless behavior of the other driver. Some examples of driver negligence include distracted driving, drunk driving, speeding, failing to yield, and violating traffic signals. Since Kentucky is considered a “pure comparative fault” state, you may still be able to collect damages even if you were partially responsible for the accident. However, the total amount of damages you will be able to collect is reduced by your percentage of fault for the accident.

Second, the accident caused you to suffer serious physical injury. While Ohio County alone averages around 700 car accidents each year, only about 20% of these resulted in bodily injury according to the Kentucky Transportation Cabinet (KTC). The goal of a personal injury claim is to provide compensation for things like medical bills or lost wages. Without serious injury, there is nothing to be compensated for and you will likely not have a valid case.

If you or a loved one have been severely injured due to another party’s negligence, you may be eligible to collect compensation. The only way to know for sure is to contact our Ohio County car accident lawyers for a free case evaluation. We can answer your questions about what can be considered negligence or what it means for an injury to be “severe”. If we determine that you have a valid case, we will get to work immediately to collect evidence, establish liability, and pursue damages from the other driver.

Semi-Truck Accidents

If you or a loved one has been involved in an accident with a semi-truck or other commercial vehicle, you likely face serious injuries and thousands of dollars in medical bills or other expenses from the crash. Many truck accident victims need months or even years to recover from their injuries, while others suffer permanent disabilities due to the crash. At Flora Templeton Stuart Accident Injury Lawyers, we believe in holding the at-fault party accountable for the damages they cause. Our Ohio County semi-truck accident lawyers have over 45 years of experience handling trucking cases and have the skills and resources necessary to go toe to toe with the big trucking companies and their attorneys. We have secured millions in compensation for our injured clients and are prepared to fight for our clients in court. Contact us today to speak with an attorney and receive free legal advice through our free case evaluation.

What Factors Contribute to Semi-Truck Accidents

There are often many factors that contribute to accidents involving semi-trucks. While road conditions or environmental factors play a part in some commercial vehicle accidents, the vast majority of these accidents are caused by some type of driver error. In fact, the FMCSA revealed that these accidents are ten times for likely to be caused by driver error than due to other factors. Some of the most common factors that contribute to semi-truck accidents are:

Driver Fatigue: State and federal laws require truck drivers to take breaks and limit their driving to no more than 11 hours in a single day. However, pressure from the trucking company causes many drivers to push through the exhaustion to meet deadlines. For this reason, driver fatigue is one of the leading causes of semi-truck accidents.

Speeding: You may have noticed that many highways have different speed limits for cars and semi-trucks. This is due to the fact that semi-trucks who travel above the speed limit are unable to slow their quickly enough to avoid road hazards and can cause devastating accidents.

Overloading: When an eighteen-wheeler exceeds federally mandated load capacities, the added weight makes braking even more difficult. These laws are in place for a reason and negligent truck drivers place everyone around them in harm’s way when they choose to disobey them.

Drug & Alcohol Use: Drug and alcohol abuse among truck drivers is a major problem and places unnecessary risk on other drivers and passengers. Operating these large vehicles is dangerous for sober truckers and adding drugs or alcohol to the mix can be a recipe for disaster.

Distracted Driving: Spending thousands of hours behind the wheel each year gives drivers countless opportunities to check their phone, change the radio station, or other activities that divert their attention away from the road. The time spent on these activities can add up quickly, and it only takes a split second to cause or avoid an accident.

While these are the most common causes of semi-truck accidents, our Ohio County semi-truck accident lawyers will conduct thorough investigations to uncover any negligent behavior that may have contributed to the accident. If you or a loved one has been injured in an accident involving a commercial vehicle, contact our Ohio County semi-truck accident lawyers today for a free case evaluation.

Motorcycle Accidents

Kentucky is home to spectacular views and beautiful scenery, making motorcycles a preferred mode of transportation for many people living in Ohio County. Many victims are left with serious injuries, as well as thousands of dollars in medical bills and other expenses from the crash.

We know the risks involved in operating a motorcycle better than most, but we also understand why so many people choose these vehicles. Our Ohio County motorcycle accident lawyers are here to protect riders, and many times that means protecting their right to fair compensation. If you or a loved one has been injured in a motorcycle accident, contact Flora Templeton Stuart Accident Injury Lawyers today.

Pedestrian Accidents

Not all of the cases we handle involves a collision between two vehicles. In fact, some of the most serious injuries occur when a car strikes a pedestrian. Pedestrians are no match for motor vehicles in a traffic accident, and these types of accidents can easily cause catastrophic injuries or death. What’s worse is that these accidents often happen when you least expect it: walking on the sidewalk, strolling through a parking lot, or traveling through an intersection. Our Ohio County pedestrian accident lawyers have been protecting the rights of our injured clients for over 45 years and we know how to get results for those in Ohio County. We will pursue maximum compensation on your behalf and get you the money you need to get back on your feet after a collision. When Insurance Pays In A Car Accident

Several types of insurance coverage that will pay if you’re injured in an automobile collision:

Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.

Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.

Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.

Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.

How We Prove Negligence in Your Auto Accident Case

Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:

Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.

Breach of duty: The at-fault party breached their duty of care, instead acting negligently.

Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.

Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.

Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.

Kentucky and Tennessee Car Accident Laws

Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.

Statute of Limitations in Kentucky and Tennessee

In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
