$1.5 MILLION SETTLEMENT FOR METCALFE COUNTY RESIDENT IN FARM TRUCK ACCIDENT

Allen and two of his daughters were driving East along KY HWY 496 when they came upon a logging truck blocking the East bound lane. With no time to react. Allen collided with the truck and despite wearing his seatbelt, the injuries to his head and face proved fatal. What Is A Personal Injury Lawsuit?

A personal injury refers to the physical injuries and financial losses resulting from another’s negligence, carelessness, or reckless act. There are a variety of factors that determine the potential value of the claim, as well as the total level of compensation awarded to victims. As Metcalfe County personal injury attorneys, it is our duty to perform a thorough investigation of the accident and build a strong case to recover maximum compensation for our clients. Some of the damages that we can recover in a personal injury claim include:

  • Property Damage
  • Pain & Suffering
  • Emotional Distress

Car Accidents

Car accidents can happen to anyone and can have a lasting impact on your health and your finances. When the accident is a caused by another driver’s negligence, you have the right to recover compensation for the damages suffered, including medical bills, lost wages, and pain & suffering. At Flora Templeton Stuart Accident Injury Lawyers, we use our decades of car accident experience and extensive knowledge of Kentucky law to get justice for our Metcalfe County clients and their families. Do I Need An Attorney?

After a car accident many people are reluctant to hire an attorney. They are either intimidated by the idea of filing a lawsuit or believe that they are receiving adequate compensation from the other driver’s insurance company. The truth of the matter is that car accident victims are rarely given fair compensation without the assistance of an experienced attorney.

The goal of many insurance companies is to devalue your claim to the lowest possible amount or find ways deny your claim altogether.  Some may even try to convince victims that hiring an attorney is not in their best interest, or that doing so will end up costing them more money in the end. By recording your statements, sending you to physicians within their network, and delaying the investigation, they are actually taking measures to build a case against you, not for you.

At Flora Templeton Stuart Accident Injury Lawyers, we do the opposite. Every step that we take is intended to strengthen your case and maximize the value of your claim. We get to work immediately to investigate the accident and preserve evidence, act as an intermediary between you and the insurance company, send you to quality physicians, and fight to get you the justice you deserve. You will never pay out-of-pocket for our legal services and can call us anytime for a free case evaluation. Contact us today to discuss the details of your case with an experienced Metcalfe County motorcycle accident lawyer.

Semi-Truck Accidents

As the largest vehicles on the roads, semi-trucks pose a serious threat to other vehicles. Weighing in at up to 80,000 pounds, even the most experienced truckers agree that big rigs are difficult to maneuver and even more difficult to slow down to avoid collisions. When negligent semi-truck drivers cause or fail to prevent a collision, the results can be catastrophic. If you or a loved one have been injured in an accident involving a semi-truck, contact us today for a free case evaluation. We have represented the injured in Metcalfe County for over 43 years and have recovered millions for truck accident victims.

Semi-Trucks: Rules and Regulations

Due to the dangers associated with these vehicles, the Federal Motor Carrier Safety Administration lays out strict guidelines that truckers must follow at all times, including:

  • Truck drivers must regularly inspect their vehicles loads’
  • Truck drivers must be over the age of 21 and able demonstrate safe driving skills
  • Truck drivers must use extreme caution or stop driving in dangerous weather
  • Truck drivers must adhere to schedules for taking rest breaks
  • Truck drivers must not exceed more than a certain number of hours behind the wheel
  • Commercial drivers may not drink alcohol up to four hours prior to driving
  • Truck drivers may not drive with a blood alcohol content (BAC) of 0.04% or greater

Additionally, the trucking company itself must adhere to certain regulations, including daily truck inspections, realistic delivery times, and more. Whenever a truck driver or trucking companies fails to meet these regulations, they can be held liable for the accident and any damages suffered by the victims. However, negligence can be difficult to prove without an experienced Metcalfe County semi-truck accident lawyer by your side, so it is important to contact our firm as soon as possible.

We take these regulations seriously because we understand how even the smallest oversight can have devastating consequences. When you call us, our team of attorneys, investigators, and specialists get to work immediately to preserve evidence and establish liability for the at-fault party. Call us today for a free case evaluation and see if you are entitled to compensation for your injuries.

Motorcycle Accidents

Flora Templeton Stuart Accident Injury Lawyers handles cases involving motorcycle accident injury or death claims. We have over 45 years of motor vehicle injury litigation experience and work diligently to protect the rights of motorcyclists in Kentucky. If you or a loved one has been injured in a motorcycle accident, let our attorneys help ease some of the financial and emotional burdens that these accidents can cause.

Common Motorcycle Crash Injuries

Compared to other vehicles on the road, motorcyclists have minimal protection that leaves them extremely vulnerable to their surroundings on the roads. Furthermore, inattentive or distracted drivers often fail to properly recognize nearby motorcyclists due to their compact size. As a result, riders tend to experience far more serious injuries even in minor crashes. Some common motorcycle crash injuries include:

  • Spinal Cord Injuries
  • Traumatic Brain Injury (TBI)
  • Neck & Back Injuries
  • Chest Injuries
  • Arm & Leg Injuries
  • Fractures
  • Burns & Road Rash
  • Amputations
  • Paralysis

Not only do these injuries cause serious physical harm, but they can create major financial and emotional burdens for victims and their families. Due to the severity of injuries that often occur, motorcyclists tend to accrue significantly higher medical bills, lost wages, and other expenses after a wreck. If you or a loved one has been injured in a motorcycle accident, it is important to contact one of our Metcalfe County motorcycle accident lawyers to discuss your options. We will investigate the accident right away and build your case while you heal from your injuries. Contact us today for a free case evaluation.

Wrongful Death

Losing a family member is one of the most traumatic experiences you can go through. This is especially true when the death could have been avoided if not for the negligence of another. If you have lost a loved one due to the negligent or wrongful actions of another, you may be eligible to file a wrongful death lawsuit. Wrongful death lawsuits provide a way for the surviving family to recover financial compensation for their losses, including:

  • Medical and funeral expenses connected to the death
  • Loss of income or expected earnings
  • Mental anguish/pain & suffering
  • Loss of consortium

In many cases, getting to the scene quickly and preserving evidence is crucial in establishing a wrongful death claim. At Flora Templeton Stuart Accident Injury Lawyers, our team of investigators can get to the scene quickly to take photographs, get witness statements, gather evidence, and more to strengthen your case. We will handle all of the details of your case and secure a favorable outcome so that you can begin the grieving process. If the negligence of another took away a loved one before their time, contact us today for a free case evaluation.

Metcalfe County Car Accident Statistics

From 2021 to 2022, Metcalfe county has had a positive trend in car accident reports, with the total number of accidents going down over 18% with 271 in 2021 and 232 in 2022. But while the total number of accidents has gone down, the severity of accidents has unfortunately risen based on data:

  • Fatal Accidents – 0 to 5
  • Non- Fatal Injuries – 58 to 37
  • Persons Killed – 0 to 6

These results show driver safety has risen, hence the drop in accidents, but Metcalfe County drivers must make sure they are wearing their seatbelts and abiding by traffic laws in order to minimize the damage when an accident inevitably occurs.

When Insurance Pays In A Car Accident

Several types of insurance coverage that will pay if you’re injured in an automobile collision:

Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.

Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.

Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.

Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.

How We Prove Negligence in Your Auto Accident Case

Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:

Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.

Breach of duty: The at-fault party breached their duty of care, instead acting negligently.

Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.

Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.

Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.

Kentucky and Tennessee Car Accident Laws

Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.

Statute of Limitations in Kentucky and Tennessee

In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
