Car Accidents

According to the Kentucky Transportation Center (KTC), there were over 134,000 motor vehicle accidents reported in Kentucky in 2018. Even though accidents are a common occurrence, many people are not prepared for the impact that these accidents can have on you or your family’s future. Aside from the serious injuries that can occur in car accident, many victims are left to deal with the financial burden that these accidents cause. Without an experienced attorney on your side, you may be stuck paying for your medical bills and other expenses on your own.

Do I Need An Attorney?

After an accident, many people are reluctant to hire an attorney. Some people don’t want to go through the claims process and trust that the insurance company is giving them a fair settlement. However, car accident victims are rarely given fair compensation without the assistance of an experienced lawyer.

In fact, most insurance companies will do everything in their power to pay the lowest amount possible after accident. They may suggest that hiring an attorney is not in your best interest or that you will get more money in the end without one. However, these companies are actively building a case against you, not for you. Even if their initial offer sounds appealing, we encourage you to speak with one of our Green County car accident lawyers before accepting an offer.

Hiring an attorney is about much more than handling all of the paperwork for your case. We go one step further by investigating the accident, preserving evidence, negotiating with insurance companies, sending you to quality physicians, and fighting on your behalf. By doing so, we give our clients the best chance of making a full recovery and receiving adequate compensation for your injuries and losses. You will never pay out-of-pocket for our legal services and can call us anytime for a free case evaluation. Contact us today to discuss the details of your case with an experienced Green County car accident lawyer.

Semi-Truck Accidents

The size and weight of a semi-truck make them some of the most dangerous vehicles on the road. As a result, accidents involving semi-trucks tend to be much more severe than typical car accidents, often causing serious injury or death. Victims may require extensive medical treatment and can spends months or even years recovering from their injuries, racking up thousands of dollars in medical bills in the process. They may also be unable to return to work or partake in day-to-day activities that they once enjoyed.

If you or a loved one has been injured in an accident involving a semi-truck, contact our Green County semi-truck accident lawyers for a free case evaluation. We have represented the injured in Green County for over 45 years and recovered millions for truck accident victims.

Who can be held liable for the injuries I sustained?

Liability in a semi-truck accident case can be difficult to pinpoint. What makes these cases so unique is that several parties can share liability for the damages in a commercial trucking accident, including:

  • Truck driver
  • Trucking company
  • Owner of the truck/trailer
  • Truck manufacturer
  • Leaser
  • Truck loader
  • Owner of the cargo
  • Maintenance company

Each party has an obligation to maintain safe conditions for the vehicle and the operator, whether that be performing regular maintenance, safely loading the cargo, or providing adequate training. If any of these parties fails to perform their duties and an accident occurs, they may be required to provide compensation to victims.

Also, because each party is a separate entity with independent insurance coverage, separate claims must be filed for each individual party who contributed to the accident. This is a major challenge for those who have been injured by a big truck, especially when many of these parties deny fault or avoid liability all together as to avoid paying compensation for your injuries

Without the necessary qualifications and experience in Kentucky trucking litigation, receiving adequate compensation is highly unlikely. Fortunately, our Green County semi-truck accident lawyers have over 45 years of experience in these cases and are well-equipped to fight on your behalf. Contact us today for a free case evaluation and discuss your options with one of our skilled attorneys.

Motorcycle Accidents

There is no question that motorcycles provide a sense of freedom that other vehicles can’t offer. However, they also come with their own set of dangers. Motorcyclists have little to protect themselves in the event of a collision and even minor collisions can result in serious injury or death. Their compact size also makes them harder to spot than larger vehicles for even the most attentive drivers. Still, drivers have a duty to safely operate their vehicles and watch for hazards regardless of size. If you or a loved one has been injured in a motorcycle accident, contact our Green County motorcycle accident lawyers for a free case evaluation.

What Damages Can I Collect After A Motorcycle Accident?

Due to the risks associated with riding a motorcycle, motorcycle crash victims tend to have far more severe injuries when a collision occurs. Because of this, riders not only have more serious injuries than car crash victims, but the costs associated with a motorcycle accident are generally much, much higher.

Nobody should be on the hook for something that wasn’t their fault, however many riders are stuck with out-of-pocket expenses when the at-fault drivers insurance company refuses to cover all of the expenses stemming from the accident. These expenses are called damages, which refers to the sum of money a victim may receive as compensation for any injuries or losses from the crash. Kentucky law permits injured motorcycle riders to pursue both economic and non-economic damages, as well as punitive damages for particularly egregious offenses.

Economic Damages, which are also known as compensatory damages, compensates victims for the monetary losses stemming from the accident. Examples of economic damages include:

  • Medical Bills
  • Long-Term Medical Care
  • Rehabilitation/Physical Therapy
  • Prescription Medication
  • Lost Wages/Loss of Earning Capacity

Non-Economic Damages, or general damages, provides compensation for the mental, emotional, and physical suffering that the victim endured due to the accident. Whereas economic damages are essentially the sum of all monetary losses in an accident, non-economic damages are subjective and more difficult to determine. Although these damages can be difficult to monetize, they can account for a large portion of your final settlement. The most common non-economic damages awarded to motorcycle accident victims include:

  • Pain & Suffering
  • Mental Anguish/Emotional Distress
  • Loss of Consortium
  • Loss of Enjoyment of Life

Your final settlement is typically a combination of both types of damages. The lawyer that you choose for representation is one of the biggest factors in determining the value of your case, especially when pursuing non-economic damages. Not only have we collected millions more motorcycle accident victims, but we are successful in over 90% of our cases. Contact us today to speak with one of our Green County motorcycle accident lawyers

Pedestrian Accidents

Drivers have a duty to exercise reasonable care to not cause injury to others when operating a vehicle. A driver who fails to do so may be deemed negligent and required to pay for any damages resulting from the accident. This duty of care extends not only to other drivers, but to pedestrians as well. Pedestrians crossing the street or standing on the sidewalk have the same rights as other motorists. If you or a loved one was injured due to the negligence of another, contact our Green County pedestrian accident lawyers today.

Wrongful Death

When a death occurs do to the willful or negligent actions of another, the deceased’s estate has a right to pursue justice. Wrongful death lawsuits provide a way for the surviving family to recover financial compensation for the tragedy, including:

  • Medical and funeral expenses
  • Loss of Income or Expected Earnings
  • Mental Anguish
  • Pain & Suffering
  • Loss of Consortium

Medical bills, funeral costs, sudden loss of income, and other expenses can add up quickly, making it difficult to fully recover and move forward. Although no amount of money will bring back a loved one, wrongful death lawsuits can help to ease the stress and financial burden of the sudden loss. They can also help to bring a sense of closure to the surviving family.

Our Green County wrongful death lawyers have been advocating for the rights of our clients who have lost family members due to the negligence of another for over 45 years. If you have lost a family member, we offer a free case evaluation so that you can discuss your options with an attorney for no charge. Contact us at 866-583-4915 today.

When Insurance Pays In A Car Accident

Several types of insurance coverage that will pay if you’re injured in an automobile collision:

Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.

Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.

Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.

Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.

How We Prove Negligence in Your Auto Accident Case

Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:

Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.

Breach of duty: The at-fault party breached their duty of care, instead acting negligently.

Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.

Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.

Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.

Kentucky and Tennessee Car Accident Laws

Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.

Statute of Limitations in Kentucky and Tennessee

In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
