Different Scenarios That Can Lead to Injury
There are a number of scenarios that can lead to personal injury, including:
- Victims can become injured after a slip and fall at a local business. Each year, slips and falls cause more than eight million emergency room visits.
- Drivers could be injured in a motor vehicle accident on their way to work. More than 700 individuals die every year from motor vehicle accidents in Kentucky.
- Pedestrians and motorcyclists could be hit by other drivers, suffering serious or fatal injuries.
Sometimes, personal injuries are unavoidable and accidental. Others are due to negligent people making poor choices or even those intentionally causing harm to another individual.
A serious injury can be traumatizing and has the potential of changing your life. Not only can you suffer from the physical pain of the injury, but you (and your loved ones) can face added financial pressure and emotional stress.
Following a personal injury, some individuals might not be able to go back to work. They lose their income just as they start receiving their medical treatment bills. When another party is responsible for this injury because of their intentional harm or negligent actions, this only compounds the trauma.
Kentucky law fortunately allows you to bring up a lawsuit against the party responsible for your injuries and seek compensation for related damages. If you’ve suffered an injury, money won’t eliminate the pain you’re suffering, but it can help alleviate some of the stress and financial pressure you’ll likely experience because of your injury.
A personal injury and the suffering it can cause can alter your life and, even if it’s just temporary, it’s still a big deal. Therefore, you should seek compensation from the party responsible for your suffering. The best way you can do this is to work with our Daviess County personal injury lawyers who have the experience to help get the settlement you deserve and quality medical treatment so you can recover from your injuries.
Should You Seek Damages?
Seeking damages is the way you recover compensation for the injuries you sustained. These damages can be:
- Lost wages
- Emotional distress
- Pain and suffering
- Lost earning potential
- Loss of companionship
- Medical bills
- Loss of enjoyment of life
- Rehabilitation costs
People often hesitate when it comes to suing another person, but most cases settle out of court with the recovery coming from the insurance company. You have to keep in mind that recovering from your injuries might rely on your financial recovery. A successful personal injury claim can relieve the burden of a pile of medical bills sitting on your kitchen countertop.
Why Choose Flora Templeton Stuart
It’s important for you to know that you have rights. Flora Templeton Stuart Accident Injury Lawyers want to help protect your rights by holding accountable the party that is responsible for your personal injuries. But, you also need to know that in the state of Kentucky, you only have two years from your injury date in a car or semi-truck accident to file a lawsuit, or one year for a personal injury case. Don’t hesitate to seek strong representation through our firm.
We have helped our clients for the past 40 years recover millions of dollars in deserved compensation. Hiring us will place you in very reliable hands. We recover compensation (verdicts and settlements) in over 90% of the personal injury cases we handle. You can rest assured we will work hard to do the very same for you.
Types of Cases Flora Templeton Stuart Handles
When it comes to personal injury cases, each state has specific regulations. The term “personal injury”, in its simplest form, refers to a tort claim where an injured individual has the right to claim damages against the party at fault. You need to prove both damages and fault in order to make a personal injury claim. There are many injuries included on the list of personal injuries.
Some of the cases we handle include:
Motor Vehicle Accidents
Hundreds of residents in Kentucky are injured each day in motor vehicle accidents. These accidents involve:
- Trucks
- Car Accidents
- Motorcycles
- Commercial trucks
- Pedestrians
General Premises Liability
Technically, slip and fall accidents are categorized under the premises liability umbrella. However, they often get their own billing because they occur often. When we say premises liability, we’re often thinking of other types of premises liability cases, including:
- Slips & falls
- Dog bites
- Building collapses
- Fires
Property owners are legally responsible for ensuring their home or business is safe. This includes providing adequate safety devices for outdoor and indoor swimming pools, controlling animals and adhering to state fire safety regulations. When property owners are negligent, they put the wellbeing and lives of other people at risk.
Slip and Fall Accidents
Slip and fall accidents often occur in public arenas like restaurants, grocery stores and parking lots. However, they can and often do occur at private residences. Whether an injury occurs at a public space or private residence, property owners are under the same obligations.
Wrongful Death
Separating a “wrongful” death from other types of death is difficult. All deaths feel wrong and unexpected. But, claims for a wrongful death cover cases where the actions (or lack of actions) of an individual or entity directly resulted in another person’s death. We work with families who have lost a loved one to help them deal with the loss and get the maximum recovery for their future.

Several types of insurance coverage that will pay if you’re injured in an automobile collision:
Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.
Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.
Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.
Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.
Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:
Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.
Breach of duty: The at-fault party breached their duty of care, instead acting negligently.
Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.
Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.
Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.
Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.
Statute of Limitations in Kentucky and Tennessee
In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
