Personal Injury Practice Areas

If you or a loved one has been injured due to the negligence of another, you have the right to be compensated for your injuries. However, not all compensation is fair compensation. The at-fault party and their insurance company may do everything they can to limit their financial responsibility. Without knowing how to protect your rights and avoid mistakes that could jeopardize your claim, you may be forfeiting substantial sums of money that can be used to pay off medical bills and other expenses stemming from the accident. You may even be stuck paying out-of-pocket for something that wasn’t your fault.

As Clinton County personal injury lawyers with almost 50 years of experience, we help our clients make informed decisions that gives them the best chance of maximizing their financial recovery. We have the skill and the resources to go to-to-toe with insurance companies and will fight to get the justice you deserve. With a success rate of over 90% and millions collected for our clients, you can rest easy knowing that our experienced team is fighting for you.

At Flora Templeton Stuart Accident Injury Lawyers, we handle all types of personal injury cases, including:

After you or a loved one has suffered an injury, you may be wondering if hiring an attorney is the right decision. We understand the reluctance to hire legal representation after an accident. Taking legal action is not only intimidating, but it costs money as well. You may think you can handle the process on your own or believe that the attorney fees will end up costing you more money in the end. In some cases, this may be true. Some people will not benefit from hiring a lawyer, especially when the accident results in only minor injury or property damage. In other cases, hiring an attorney is the best way to protect yourself and your finances.

The only way to know for sure whether or not hiring an attorney is in your best interest is to speak with someone who knows the ins and out of the legal system. We understand that not everyone has access to a friend or family member that can help them come to informed decision, which is why we offer a free case evaluation to anyone seeking legal advice. During your risk-free consultation, you can speak with an attorney who can answer your questions and provide clear recommendation on how to move forward. We will never pressure our clients into making a decision that is not in their best interest and will not try to sell you on our legal services. Instead, our team will lay all of your options out on the table so that you can feel comfortable and confident moving forward.

Common Car Accident Injuries

In some cases, car accidents victims can walk away from the scene with only minor scrapes or bruising. Unfortunately, many people aren’t so lucky and can sustain serious, and potentially life threatening, damage to their body. Some of the most common injuries in car accidents include:

Soft Tissue Injuries: The muscles, tendons, and ligaments found in the human body are not meant to withstand the force generated by car accidents. These accidents can cause soft tissue to stretch or tear, resulting in painful injuries that may persist long after the crash. The symptoms of soft tissue injuries may occur immediately or may take a few days to emerge. For example, cases of whiplash may not cause problems initially but could get worse over time. Regardless of when symptoms first appear, these injuries can be quite serious and should be addressed as soon as possible.

Fractured or Broken Bones: The average car can weigh over 4,000 pounds and travel at speeds exceeding 70 mph on the highway. Anything that heavy and traveling at those speeds can easily break bone, which is why many car accident victims suffer bone breaks or fractures. Broken legs, arms, ribs, wrists, and ankles are some of the most common injuries that our clients sustain.

Head Injuries: Head injuries, such as concussions, traumatic brains injuries, contusions, and skull fractures, are among the most common injuries reported after an auto accident. A sudden blow or jolt to the head can lead to physical and/or cognitive disabilities that can have life-altering consequences.

Chest/Abdominal Injuries: When a collision causes a vehicle to come to a sudden and violent stop, those inside may be thrown into the steering wheel, dashboard, or other internal area of the vehicle. This blunt force trauma to the chest and abdomen can damage major organs or lead to internal bleeding. These injuries often require surgery and may even be life-threatening.

Spinal Cord Injuries: Trauma to the spinal cord or the surrounding tissue hinders the spinal cords ability to communicate with the rest of the body. If the trauma causes the spinal cord to bruise, partially tear, or completely tear, crash victims may experience long-term disability, including paralysis or impaired motor function.

Semi-Truck Accidents

Few types of accidents have the ability to cause the level of damage that semi-truck accidents are capable of. As the largest and heaviest vehicles on the road, accidents involving semi-trucks tend to be the most severe and often cause far more serious injuries than typical auto accidents. Due to the critical nature of the injuries, trucking insurance claims are generally more substantial than other personal injury claims. As a result, trucking companies take various steps in order to protect themselves and minimize their financial responsibility in the event of an accident.

Between the trucking companies’ extensive protective measures and their army of lawyers, obtaining fair compensation can be challenging without the right help. Fortunately, our Clinton County semi-truck accident lawyers have decades of experience in truck accident litigation and will stand up to the insurance company to get you the justice you deserve. Contact us today to speak with an attorney who cares about you.

Common Types of Semi-Truck Accidents

There are several types of collisions that involve semi-trucks. Some of the most common include:

Rollovers: A semi-truck that is going too fast around a turn or who loses control of their vehicle can cause the trailer to become unbalanced and rollover. The trailer itself and the contents that fall out of the trailer creates a serious hazard for other motorists.

Wide Turns: The length of these vehicles require them to make much wider turns than the average car. If there is another vehicle in the space needed to successfully complete the turn, a collision can occur.

Sideswipes: One of the most common types of semi-truck accidents are sideswipe collisions. These accidents typically occur when a trucker is attempting to change lanes and strikes another vehicle. If another vehicle is in the truck’s blindspot, the truck is likely to hit the other car.

Jackknifing: A jackknife accident occurs when a semi-truck comes to a sudden stop, but the momentum causes the trailer to keep moving forward. This causes the trailer to swing outward and can easily cause the whole vehicle to rollover.

Rear-End Collision: The heavier the vehicle, the more time it takes to come to a complete stop. Many rear-end collisions occur because the semi-truck cannot break in time and runs into the back of another vehicle.

No matter what type of semi-truck accident occurs, each present their own dangers and potential hazards for motorists. If you have been involved in any of these types of accidents, contact our Clinton County semi-truck accident lawyers for a free case evaluation.

Motorcycle Accidents

Any type of motor vehicle accident is highly dangerous and can cause serious injury. According to the NHTSA, about 27% of all vehicle accidents resulted in injury. Even with modern safety features, passenger vehicles still kill thousands of people each year. However, standard cars are still nowhere near as dangerous as motorcycle, where over 95% of accidents involving motorcycles results in some type of injury. Due to the lack of protective measures in place, injuries in motorcycle accidents are often more severe and may lead to permanent disability or death.

Because of the severity of injuries commonly found in motorcycle accidents, insurance claims are typically much higher in these types of accidents. Victims can have thousands of dollars in medical bills, lost wages, and other expenses and losses from the accident. When someone else is at fault, you and your family deserve full compensation for the accident. Our Clinton County motorcycle accident lawyers will not only fight for maximum recovery, but we will handle all of the details so that you can focus on healing.

If you or a loved one has been injured in a motorcycle accident, contact us today to speak with an attorney who truly cares about you. We never collect any up-front fees, and the initial consultation is completely free of charge. Our Clinton County motorcycle accident lawyers work on a contingency fee basis meaning that we don’t get paid unless we are successful in your case.

Wrongful Death

Losing a loved is one of the most traumatic experiences you can go through. After the death, you likely have a lot on your mind. However, along with the grief, you may also have concerns about the more practical matters that come with losing a loved one. You may be wondering how you can afford the burial costs or medical bills stemming from the accident. You may also be left without the income that the deceased once provided.

We understand that no amount of money will bring back a loved one, but our Clinton County wrongful death lawyers know that taking legal action could be the only way to protect your family’s future. Our lawyers will fight to recover maximum compensation for our clients, which includes compensation for:

  • Medical and funeral expenses
  • Loss of victim’s expected earnings
  • Pain and suffering
  • Loss of consortium
  • Loss of companionship
  • Loss of services

We believe in holding the negligent party accountable for their actions and protecting the future of the surviving family. If you have lost a loved one in an accident, contact Flora Templeton Stuart Accident Injury Lawyers today. We offer a free case evaluation for all potential clients and will walk you through your legal options.

Premises Liability

An injury that occurs on property that is under the control of another person, company, or government agency, you may be eligible to recover compensation for your injuries and losses. Property owners have a duty to exercise reasonable care to avoid injury to their invited guests When a property owner fails to fulfill this responsibility, whether by negligence or intentional behavior, they can be held liable for the damages they caused.

The most common type of premises liability cases are slip & fall accidents. These accidents occur when a property owner knew or should have known about a potential hazard but failed to address it. For example, if a store owner fails to salt an icy walkway on their property and a patron slips, the store owner can be held liable for the medical bills, lost income, and any other damages incurred by the victim due to the accident. We also handle premises liability cases involving dog bites, swimming pool accidents, negligent security claims, playground accidents, and more.

These cases can be extremely complex, and the outcome of your cases can depend on a variety of factors. To protect your rights and your settlement, contact one of our Clinton County slip and fall lawyers for a free case evaluation. We will walk you through premises liability laws and advise you on how to proceed with your case.

When Insurance Pays In A Car Accident

Several types of insurance coverage that will pay if you’re injured in an automobile collision:

Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.

Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.

Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.

Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.

How We Prove Negligence in Your Auto Accident Case

Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:

Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.

Breach of duty: The at-fault party breached their duty of care, instead acting negligently.

Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.

Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.

Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.

Kentucky and Tennessee Car Accident Laws

Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.

Statute of Limitations in Kentucky and Tennessee

In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
