Flora Templeton Stuart Accident Injury Lawyers recently represented a Greenville woman who was seriously injured in a motor vehicle accident in Muhlenberg County, KY.
Our client, Janice, was traveling east on Highway 176 when she was struck in the rear by a negligent driver. Janice’s vehicle was propelled into oncoming traffic and collided with a school bus carrying several children. When police arrived on the scene, our client was experiencing intense pain in her neck and was immediately transported to Muhlenberg Community Hospital by ambulance for treatment.
Our office, along with the Muhlenberg County Sheriff’s Department, performed a thorough investigation and determined that the accident was caused by driver negligence. We found that the driver who rear-ended our client was not under proper control of his vehicle and was therefore liable for any damages resulting from the accident. This allowed our team to pursue damages against the at-fault party and obtain compensation on Janice’s behalf.
The Damages
When our attorneys first consulted with Janice at her home in Greenville, she was in serious pain and had limited mobility. Her physicians at the time opted for conservative treatment rather than surgical intervention and ordered Janice to undergo physical therapy.
When her condition worsened, we provided a referral to a neurologist who diagnosed our client with a severe cervical disc herniation. These types of injuries often occur due to forceful and rapid movements in the neck, known as whiplash, and can be extremely painful. Some whiplash injuries will heal with time, however the damage to Janice’s cervical spine was so severe that surgery was the only option.
Additionally, Janice was unable to return to work for an extended period of time while recovering from her injuries. This not only resulted in loss of income, but also negatively impacted her standing with the company as she was no longer able to perform her work duties without restrictions.
The Result
After multiple surgeries and months of physical therapy, Janice had accrued over $65,000 in medical bills and thousands of dollars in lost wages. Due to the nature and extent of the damages Janice suffered in the collision, our attorneys prepared for litigation and entered negotiations with the insurance company.
We were able to obtain a settlement of over $75,000 on behalf of our client—the policy limits of the at-fault drivers’ insurance. The settlement allowed Janice to pay off all of her medical bills and provided compensation for any wage loss resulting from the accident.
