Albert’s Story: Maximum Compensation for Madisonville Crash Victim

Image of a stop sign representing an injury client who was severely hurt in a Kentucky car accidentFlora Templeton Stuart Accident Injury Lawyers recently traveled to Madisonville to meet with a man who was seriously injured in a car accident. Our client, Albert, was seriously injured when a negligent driver blew through a stop sign and violently struck his vehicle. Albert’s injuries not only required immediate surgery but would also necessitate months of physical therapy and chiropractic treatment.

During treatment, Albert was unable to return to work and earn an income. Our team immediately reserved PIP benefits to recover these lost wages, as well as securing the at-fault driver’s policy limits. Our attorneys were able to recover over $40,000 in damages from the at-fault driver’s insurance, allowing Albert to recover from his injuries and move forward with his life.

The Accident

Our client was traveling east when he approached the intersection at East Broadway and Scott Street in Madisonville. After coming to a full stop, Albert accelerated through the intersection but was struck by another vehicle who ran the stop sign. Due to the severity of his injuries, Albert was taken by ambulance to Baptist Health Madisonville for immediate treatment.

Officers from the Madisonville Police Department who responded to the scene cited several human factors that contributed to the accident. Their official accident report found ‘Disregard Traffic Control’ and ‘Inattention’ by the at-fault driver to be the primary factors involved in the collision, which we were able to confirm through our own independent investigation.

The Damages

Although he was wearing a seatbelt at the time of the accident, the force of the collision sent Albert smashing into the interior of the vehicle. This resulted in several impact injuries, including contusions, a torn ligament in his knee, and a torn meniscus.

Not only was Albert required to undergo both reconstructive and arthroscopic surgery to repair the damage to his knee, but he also needed months of rehabilitation and regular visits to a chiropractor for chronic pain stemming from the crash.

To give him the best chance at a full recovery, our attorneys provided referrals to excellent physicians to address his injuries.

In total, Alberts accrued more than $35,000 in medical bills alone. He also missed 11 weeks of work while recuperating, which had an undeniable adverse effect on his position with the company in addition to the thousands of dollars in lost wages.

One of the first things our attorneys do for our injured clients is reserve personal injury protection benefits to help with any expenses related to the accident.

Personal injury protection, or PIP, is mandatory for all drivers in the state of Kentucky and can pay for things like medical bills and lost wages regardless of who was at fault for the accident. In this case, PIP paid Albert for all the work he missed while recovering.

Furthermore, our attorneys were able to establish that the other driver was liable for all of Albert’s damages. This allowed our team to obtain a settlement from the at-fault drivers insurance company for nearly $50,000- the maximum amount available to our client.

Maximizing compensation is always our goal at Flora Templeton Stuart Accident Injury Lawyers. In this case and thousands of others, we were able to negotiate a settlement that covered all costs incurred by our client. Please call Flora and her team at (888) 782-9090.
