What Constitutes a Personal Injury Accident In Tennessee
A personal injury claim is a type of legal claim called “negligence.” When someone is found to be negligent, it means they can be held legally responsible for any injuries and financial expenses that result.
To win on a negligence claim in Tennessee, you must be able to prove four elements:
- That the defendant owed you a legal duty;
- That the defendant breached that duty by failing to act reasonably under the circumstances;
- That you suffered actual damages; and
- That your injuries were caused as a result of the defendant’s breach.
If you can prove the opposing party’s negligence, you can receive valuable compensation to help you recover from your injuries. When you are involved in a personal injury accident, you want an attorney that knows exactly what to do. An experienced personal injury lawyer can help you analyze your case, gather evidence, and do what needs to be done to help you prove your negligence claim.
Flora Templeton Stuart handles negligence claims day in and day out. She knows how to successfully navigate a personal injury claim from beginning to end, and she is just the attorney for you.

Car Accidents
In 2019, there were 204,673 motor vehicle crashes in the state of Tennessee. 48,420 of these resulted in injuries.
Unfortunately, however, a car accident can result in more than just serious physical injury.
After a car accident, victims are often left with substantial medical bills, property damage, emotional trauma, and lost income and earning capacity as they recover from their injuries.
If you are dealing with the repercussions of a car accident due to the wrongful or negligent actions of someone else, you may be entitled to relief. Contact Tennessee car accident attorney Flora Templeton Stuart to discuss your case.
Commercial Trucking Accidents
The wreckage left behind in the aftermath of a Tennessee commercial trucking accident can be devastating. Due to their size alone, semi-truck accidents can be significantly more dangerous than car accidents. Additionally, commercial truck drivers are frequently on the road for long periods of time, which can lead to dangerous conditions that are more likely to result in collisions.
In fact, some of the most common causes of truck accidents in Tennessee include:
- Following improperly,
- Lane departures,
- Improper lane changes, and
- Drivers that are apparently asleep or fatigued.
When a truck driver’s negligence leads to an accident, the results can be severe and life-threatening.
Our Tennessee semi-truck accident lawyers can help you get the compensation you need to recover and hold drivers accountable to make our highways a safer place.
Motorcycle Accidents
Out of nearly 400,000 Tennessee residents licensed to ride a motorcycle in 2019, 7% of riders were involved in a motorcycle accident. Of the total motorcycle accidents in 2019, 152 were fatal.
Though motorcycles are statistically more prone to accidents than passenger car vehicles, the fact remains that riding is a thrilling experience that you just can’t get in a car. However, the rules of the road should not change simply because you are on a motorcycle. If you sustain injuries due to the actions of a negligent motorist, you need competent representation to get you the compensation and relief you deserve.
In our almost 50 years in practice, we have represented countless motorcyclists, doing so successfully in over 90% of cases. We are passionate about representing motorcyclists, and we want to help you too.
Pedestrian Accidents
According to the National Highway Traffic Safety Administration (NHTSA), one pedestrian was killed in a traffic crash every 88 minutes in 2017. As a pedestrian, it is important to take precautions to prevent involvement in a traffic-related accident. However, the burden is not only yours.
Drivers owe pedestrians a legal duty to drive safely in a reasonable manner in an effort to prevent pedestrian accidents. In fact, motorists on Tennessee roads are required by law to exercise due care when in the presence of pedestrians. When a driver breaches that duty, resulting in an accident, injured pedestrians may be entitled to relief.
If you or a loved one has sustained injuries at the hands of a negligent driver, contact Flora Templeton Stuart’s pedestrian accident attorneys today.
Bicycle Accidents
Despite calls to protect bicyclists on Tennessee roads, bicycle-related accidents continue to be a serious concern each year. In 2018, there were 378 bicycle-related traffic crashes in the State of Tennessee. This number increased to 394 in 2019.
Common causes of bicycle-related traffic accidents include:
- Distracted drivers,
- Failure to yield,
- Drunk driving, and
- Failure to properly share a lane with bicyclists.
Bike-related traffic accidents can result in severe injuries, including fractures, concussions, internal injuries, and spinal cord, neck, and back injuries. If a motorist’s negligent driving causes injuries to you while you are on your bike, you may have a claim for relief. Contact Tennessee bicycle accident attorney Flora Templeton Stuart to discuss your case and see how we can help you recover.

Several types of insurance coverage that will pay if you’re injured in an automobile collision:
Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.
Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.
Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.
Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.
Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.
