Do I Need To Hire A Lawyer After An Auto Accident?
After an accident, you may be wondering if hiring a personal injury attorney is the best choice for you.
For accidents resulting in only minor injuries or property damage, you may be able to handle your case on your own. However, when a more serious crash occurs, it is a good idea to speak with an attorney to determine whether a personal injury lawsuit is in your best interest.
One important consideration for accident victims is that, on average, those who hire an attorney after a car accident received 40% higher settlements than those without.
Additionally, the claims process can take more than twice as long without an attorney on your side. This is due to the complexity of the cases, as well as the bargaining power of a skilled team of attorneys.
By navigating the legal system alone, you may end up spending much more time and energy for a smaller settlement.
Fortunately for our clients, we take all the guesswork out of this major decision.
Through our free case evaluation, Warren County accident victims can speak to an attorney and share the details of their case to determine the best course of action. A case evaluation is completely free and there is no catch if you decide to handle the process on your own. Call us today.
Should I Visit The Doctor For Minor Injuries?
Many people who have been involved in a minor car accident want to put the whole situation behind them as quickly as possible. Dealing with the insurance company and repairing your vehicle can be stressful, and victims may neglect their injuries to expedite the process. After all, making a doctor’s appointment for a few cuts and bruises may seem unnecessary with everything else going on.
However, visiting the doctor is one of the best ways to protect yourself after a crash and we encourage all our clients to get evaluated by a medical professional regardless of their injuries.
There are several reasons why immediately seeking medical treatment is crucial, the first being that your injuries could get worse over time. Certain injuries, like whiplash, can take a few days to become bothersome or may be aggravated by physical exertion.
Not only can this have negative effects on your health and well-being, but it can hurt your chances of getting fair compensation if you decide to file a personal injury lawsuit.
Delaying treatment can leave room for the other driver’s insurance company to cast doubt on the extent of your injuries. Without proper documentation from your medical provider’s official records, the cause and severity of your injuries can be disputed.
Insurance companies will try to devalue your claim or deny it altogether, which is why seeking medical treatment is crucial to a successful personal injury case.

Semi-Truck Accidents
Accidents involving semi-trucks or other large vehicles are not only far more dangerous than standard car accidents, but they are also more complicated from a legal standpoint. Call 888-782-9090 or fill out the form at the bottom of the page to speak with a Warren County semi-truck accident lawyer today.
How Do Semi-Truck Accidents Differ from Other Types of Auto Accidents?
One of the major differences between semi-truck accidents and standard car accidents is the severity of injuries caused by each accident category. While car accidents kill thousands of people each year, the proportion of accidents involving semi-trucks that result in serious injury or death is much higher.
This is largely due to the weight and size of these vehicles, as well as these vehicles being more difficult to maneuver and come to a complete stop.
Additionally, multiple parties may share liability in a semi-truck accident. Instead of holding only the other driver responsible, separate claims may have to be filed against the trucking company, the driver, the loading company, the maintenance company, or several other parties who are responsible for maintaining the safety of the tractor-trailer.
Consequently, trucking companies carry more extensive insurance policies to cover the damages and are often willing to pay substantial legal fees to protect their finances. This not only makes semi-truck accident cases complex, but they also require considerably more time and effort to build a successful case.
Without an experienced Warren County semi-truck accident lawyer to guide you through this process, receiving adequate compensation for your injuries can be extremely difficult.
Motorcycle Accidents
More motorcycles are on the road than ever before, which means more riders are being seriously injured by negligent drivers. Due to the risks associated with riding a motorcycle, motorcycle crash victims tend to have far more severe injuries when a collision occurs.
Because of this, riders not only have more serious injuries than car crash victims, but the costs associated with a motorcycle accident are generally much, much higher.
In order to receive adequate compensation for your injuries, you will need an experienced Warren County motorcycle accident lawyer on your side.
We have recovered millions for injured riders and their families over our 45-plus year career, and we know how to get results.
If you have suffered an injury or lost a loved one in a motorcycle accident, contact our Warren County motorcycle crash attorneys today at 888-782-9090.
What Damages Can I Collect After A Motorcycle Accident?
Nobody should be on the hook for something that wasn’t their fault, however many riders are stuck with out-of-pocket expenses when the at-fault driver’s insurance company refuses to cover all the expenses stemming from the accident.
These expenses are called damages, which refers to the sum of money a victim may receive as compensation for any injuries or losses from the crash.
Kentucky law permits injured motorcycle riders to pursue both economic and non-economic damages, as well as punitive damages for particularly egregious offenses.
Economic Damages, which are also known as compensatory damages, compensates victims for the monetary losses stemming from the accident. Examples of economic damages include:
- Medical Bills
- Long-Term Medical Care
- Rehabilitation/Physical Therapy
- Prescription Medication
- Lost Wages/Loss of Earning Capacity
Non-Economic Damages, or general damages, provides compensation for the mental, emotional, and physical suffering that the victim endured due to the accident.
Whereas economic damages are essentially the sum of all monetary losses in an accident, non-economic damages are subjective and more difficult to determine.
Although these damages can be difficult to monetize, they can account for a large portion of your final settlement. The most common non-economic damages awarded to motorcycle accident victims include:
- Pain & Suffering
- Mental Anguish/Emotional Distress
- Loss of Consortium
- Loss of Enjoyment of Life
Your final settlement is typically a combination of both types of damages. The lawyer that you choose for representation is one of the biggest factors in determining the value of your case, especially when pursuing non-economic damages.
Not only have we collected millions for motorcycle accident victims, but we are successful in over 90% of our cases. Contact us today to speak with one of our Warren County motorcycle accident lawyers.

Several types of insurance coverage that will pay if you’re injured in an automobile collision:
Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.
Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.
Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.
Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.
Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:
Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.
Breach of duty: The at-fault party breached their duty of care, instead acting negligently.
Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.
Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.
Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.
Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.
Statute of Limitations in Kentucky and Tennessee
In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
