Don & Rebecca’s Story: $200,000+ for family involved in 5-car collision
Flora Templeton Stuart Accident Injury Lawyers took the case of two people who were involved in a 5-car pile-up in Sumner County, Tennessee. Our clients, Don and Rebecca, were stopped at a red light when another vehicle rear-ended them at a high rate of speed. This caused a chain reaction where a total of five vehicles sustained damage with multiple parties requiring medical treatment, including both of our clients. Our team immediately performed a thorough investigation to determine liability in the accident, which included obtaining witness statements, hiring crash experts and accident reconstructionists, and working with the Sumner County Police Department to corroborate the facts of the collision. After building a case and preparing for litigation in the Sumner County court system, we successfully negotiated a six-figure settlement with the at-fault driver’s insurance company. Read the Full Case Summary Here.

OUR TEAM OF EXPERTS

Our accident injury attorneys have longstanding relationships with investigators, accident reconstructionists and expert witnesses. They obtain statements from the at-fault parties and any witnesses, photograph the scene or vehicles involved. Our expert reconstructionist and engineers can help prove liability against the at-fault party, whether it be a semi-truck, commercial vehicle, motorcycle or passenger car. It is important that you contact our firm right away, so that our team can get started examining evidence before it is lost or destroyed. Evidence is essential to prove your case.

OUR RELATIONSHIPS

Our attorneys have years of experience handling cases, and it is very common for us to encounter the same insurance companies and adjusters on multiple occasions or even a consistent basis. It is a tremendous advantage if your attorney has experience with a particular insurance company or adjuster, so they can better advise you on the actions or offers that the adjuster may make.   They know we will fight for our clients.

How Do I Pay My Medical Bills After An Accident in Tennessee?

If you have been injured in a car accident in Tennessee, you may be wondering how your bills are going to be paid. Many crash victims rack up tens of thousands of dollars in medical bills alone for a wreck that wasn’t even their fault.

Unlike Kentucky and many other states who offer Personal Injury Protection (PIP) coverage, Tennessee law requires accident victims to initially pay for their own medical expenses. Car accident settlements can months to finalize, and most providers may not wait that long for payment. Fortunately, there are several options available for drivers and passengers to pay their medical bills in the event of an accident, including:

    • Health Insurance: Ideally, your health insurance should pay for your immediate care and any new expenses incurred during treatment. This approach can prevent crash victims from taking on debt and potentially ruining their credit scores. Once your personal injury claim is settled, your health insurance company may seek subrogation from the at-fault driver’s insurance policy.

MedPay: Many auto insurance companies offer an added layer of protection, known as Medical Payments Coverage, to help with bills resulting from motor vehicle accidents. MedPay provides coverage for the injuries that you or your passengers suffer in a car accident, regardless of who caused the collision. Since this is an optional add-on to your existing car insurance policy, only those who have purchased some form of MedPay coverage can collect benefits.

  • Medical Provider Lien: Another option for paying off medical bills after an accident is to obtain a medical lien from your health care providers. This is especially useful for those who have no health insurance, no MedPay coverage, or have reached their policy limits. It is important to note that these funds must be repaid from your personal injury settlement when your case is resolved, so be sure to consult with an experienced attorney before agreeing to this arrangement.
  • TennCare: Tennessee’s Medicaid program, TennCare, provides medical benefits to low-income individuals. Those who qualify for TennCare can submit their hospital bills to Medicaid for payment, who will then seek reimbursement for any money spent to cover your medical expenses. This process can be extremely complex, so it is important to speak with an attorney who has experience handling these types of claims.

How Long Do I Have To File A Case In Sumner County?

If you have been injured due to someone else’s negligence, a personal injury lawsuit is often the only way to ensure that you receive full compensation for your injuries and losses. Without litigation, you may be stuck paying for things like medical bills and property damage on your own.

Determining whether or not you qualify for compensation is the first step in the legal process, but the second step is making sure your lawsuit is filed within a certain amount of time. This deadline is known as the statute of limitations and it plays a crucial role in the validity of your case.

Most people have heard the term ‘statute of limitations’ before, but not everyone understands what it means or how it applies to car accidents and other types of personal injury cases. In short, each state places a deadline on the amount of time you have to file a personal injury claim. By failing to file suit within that period, you will forfeit your right to compensation regardless of who was at fault. In most states, the time to file is between 2-4 years from the date of the accident.

This is not the case in Tennessee, however, which is one of only three states in the country to use the one-year rule. This means that if you have been injured in a car accident, you only have one year from the date of the accident to file a personal injury claim. On day 366, your case will be considered invalid, and you are no longer eligible to recover damages from the at-fault party.

Because Tennessee’s statute of limitations provides only a short period of time to file a claim, it is imperative to contact our Sumner County car accident lawyers as soon as possible after a wreck. Our team will not only ensure that your case is filed in time, but we will handle all the details of your case so you can focus on healing. We always pursue maximum compensation for our injured clients and can help you get your life back on track.

Types of Motor Vehicle Accidents

Each and every accident in Sumner County, Tennessee is unique to the circumstances around it, the most common accidents we see happening on the road with our injured clients are as follows:

  • Drunk Driving Accidents: Unfortunately driving under the influence of alcohol or drugs account for at least 20% of car fatalities and wrongful death accidents.
  • Reckless Driving Accidents: This is seen most commonly with speeding as one of the most common accidents that you see in Sumner County and in Tennessee.
  • Bad Weather: Sometimes heavy fog, rain, or snow can cause slippery roads and decreased visibility for drivers. This is particularly common in winter months.
  • Distracted Drivers: Increased use of the cell phone while driving is a frequent distraction in addition to the radio, talking to passengers and other actions that keep the driver from watching the road.

When Insurance Pays In A Car Accident

Several types of insurance coverage that will pay if you’re injured in an automobile collision:

Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.

Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.

Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.

Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.

How We Prove Negligence in Your Auto Accident Case

Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:

Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.

Breach of duty: The at-fault party breached their duty of care, instead acting negligently.

Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.

Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.

Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.

Kentucky and Tennessee Car Accident Laws

Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.

Statute of Limitations in Kentucky and Tennessee

In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
