Car Accidents

Although car accidents are a common occurrence, many people are not prepared for the impact that these accidents can have on you or your family’s future. A serious injury after a car accident can have a dramatic impact on your body, your finances, and your everyday life. Many victims have lifelong complications stemming from the accident which may prevent them from partaking in activities they once enjoyed or returning to work. On top of that, you may be stuck with thousands of dollars in medical bills and other costs as a result of the crash.

If you have been injured in a car accident, Flora Templeton Stuart Accident Injury Lawyers can help. We understand the pain and frustration that an accident can cause, which is why we handle the claims process so that you can focus on healing. Our Russell County car accident lawyers will refer you to quality physicians, investigate the accident, build your case, and negotiate with insurance companies to maximize your settlement. Contact us today for a free case evaluation and take the first step toward getting your life back on track.

Semi-Truck Accidents

As the largest and heaviest vehicles on the road, semi-trucks have developed a reputation for the dangers they pose to motorists—and for good reason. Collisions involving eighteen wheelers typically cause far more serious injuries than standard car crashes, with many resulting in at least one fatality. Even if you survive an accident with a big rig, chances are that your injuries require extensive medical treatment, such as surgery and physical rehabilitation. Even then, some victims never fully recover and may develop long-term or permanent disabilities.

If you or a loved one has been in an accident involving a semi-truck, contact our Russell County semi-truck accident lawyers for a free case evaluation. We believe in making victims whole again after an accident and will fight for a fair settlement on your behalf. We work with industry experts to build a strong case and command higher settlements. With a success rate of over 90% and millions recovered for our clients, Flora Templeton Stuart Accident Injury Lawyers can get you the settlement you deserve. Contact us today to speak with an experienced Russell County truck accident attorney.

Damages In Semi-Truck Accident Cases

In a personal injury claim, the damages that are available to victims are split into two categories: economic and non-economic damages.

Economic Damages: Pursuing economic damages are more straight-forward than non-economic damages due to their quantifiable nature. They are the verifiable, measurable, or ‘real’ losses sustained in the semi-truck accident. These can include things like medical expenseslost wageslost future earnings, and property damage where a dollar amount can be objectively determined. For example, if an accident victim had $25,000 in medical bills due to the crash, our team would demand payment for the full amount of these expenses.

Non-Economic Damages: Non-economic damages are much more difficult to calculate than economic damages. While economic damages recover the financial losses directly related to the accident, non-economic damages seek monetary compensation for losses that are not quantifiable in nature. These damages include pain & sufferingemotional distressloss of enjoyment of life, or loss of companionship. These types of damages are highly subjective and are different for each case.

Most personal injury cases pursue a combination of these damages depending on the victim’s losses. While some damages may be easier to recover, building a strong case and hiring the right attorney is the only way to recover non-economic damages and maximize your settlement. Our Russell County semi-truck injury lawyers have decades of experience maximizing settlement for our clients, including a $2.825 million settlement for the victim of a negligent truck driver. Contact us today to speak with an attorney and see what damages are available in your case.

Motorcycle Accidents

Riding a motorcycle can be dangerous for even the most skilled riders. Motorcycles lack the same physical barriers and safety measures to protect you in the event of an accident as other vehicles on the road. As a result, these types of accident tend to result in more serious injuries, even in low-speed or low-impact collisions.

If you have been hurt in a motorcycle accident in Russell County, the attorneys at Flora Templeton Stuart Accident Injury Lawyers can help you get the justice and compensation you deserve. We are dedicated to representing injured riders and have recovered millions for our clients involved in motorcycle accidents throughout Kentucky.

Slip & Fall/Premises Liability

When hazardous conditions cause an injury on someone else’s property, a premises liability claim may be necessary to recover compensation for the injury. Property owners, including building owners, property managers, landlords, and homeowners, have a responsibility to ensure the safety of their invited guests. Also known as the duty of care, this responsibility requires property owners to take reasonable care to keep their properties safe. This can include making repairs, keeping walkways free from hazards, cleaning up spills, or instituting security measures to keep people on the property safe.

A property owner who is aware or should have been aware of a potential hazard and fails to address it may be held accountable for the injuries sustained on their property.  For example, if the property owner fails to salt the icy walkway leading to the entrance of the building, a patron who slips and falls may pursue legal action against the owner for their injuries. Although slips and falls are the most common type premises liability claim, these claims may also involve:

  • Dog bites/animal attacks
  • Swimming pool accidents
  • Stairway, elevator, or escalator accidents or defects
  • Inadequate building security leading to injury/assault

As Russell County personal injury lawyers, we handle all types of premises liability claims. If you have been injured due to the unsafe conditions on public or private property, contact us today for a free case evaluation.

When Insurance Pays In A Car Accident

Several types of insurance coverage that will pay if you’re injured in an automobile collision:

Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.

Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.

Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.

Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.

How We Prove Negligence in Your Auto Accident Case

Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:

Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.

Breach of duty: The at-fault party breached their duty of care, instead acting negligently.

Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.

Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.

Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.

Kentucky and Tennessee Car Accident Laws

Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.

Statute of Limitations in Kentucky and Tennessee

In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
