Types of Car Accident Cases We Handle

In 2018 alone, Monroe County experienced over 150 car accidents according to the Kentucky Transportation Cabinet. However, not all of these crash victims will benefit from a personal injury lawsuit.

Whether or not you need to file a lawsuit depends on a variety of factors. You must consider the cause of the accident, determine fault, and establish liability for any damages resulting from the crash. Most importantly, you must consider the extent of the injuries sustained in the accident.

Whenever negligent, reckless, or careless behavior causes serious injury, you have the right to seek compensation for medical bills, lost wages, and other expenses stemming from the accident. We have represented thousands of car accident victims who have been injured in all types of crashes, such as:

  • Head-on collisions
  • Hit-and-run crashes
  • Rollover accidents
  • Drunk driving accidents
  • Rear-end collisions
  • Distracted driving accidents
  • T-Bone collisions
  • Multiple vehicle accidents
  • Side-impact collisions

Many cases involving minor injury or property damage can be settled with the at-fault party’s insurance company without legal assistance. For those who have suffered more serious injuries, including broken bones, internal injuries, spinal cord injuries, and brain injuries, consulting with our Monroe County car accident lawyers may be in your best interest.

The only way to know for sure is to call 866-583-4915 or fill out the online case evaluation form at the bottom of the page. One of our attorneys will review your case, completely free of charge, and discuss your options with you. Contact us today and see if hiring a car accident lawyer is the best option for you.

Semi-Truck Accidents

Accidents involving semi-trucks tend to be some of the most serious cases we handle. The size and weight of these vehicles can cause catastrophic injury to drivers & passengers. These injuries are not only life-altering, but many victims require long-term medical care that can be very expensive. Many victims have hundreds of thousands of dollars in medical bills, lost wages, and other expenses stemming from the accident.

Additionally, getting fair compensation from the at-fault party’s insurance company can be challenging. There are often multiple parties involved including the driver, the trucking company, the manufacturer, the truck/trailer owner, and their insurance companies.

Each party will attempt to limit their financial responsibility by employing a team of lawyers and adjustors to pay as little as possible to accident victims. Without the assistance of our Monroe County semi-truck accident lawyers, you may be stuck paying substantial sums of money for something that wasn’t even your fault.

If you or a loved one has been injured in a semi-truck accident, you have every right to pursue compensation for your injuries and losses. We have over 45 years of experience in truck accident litigation and have collected millions for our injured clients, including several multimillion-dollar settlements for semi-truck accident victims. Our Monroe County semi-truck accident lawyers have the knowledge, skills, and resources to get the compensation you deserve. Contact us today for a free case evaluation.

Motorcycle Accidents

According to the National Highway Traffic Safety Administration (NHTSA), around 80% of all motorcycle accidents resulted in injury or death, compared to only 20% in passenger vehicles. Along with potentially life-threatening injuries, crash victims are often left with thousands of dollars in medical bills, lost wages, and other expenses stemming from the accident. Sadly, liability and compensation in these types of crashes are often highly contested due to the perceived dangers of motorcycles. Without the help of our Monroe County motorcycle accident lawyers, you may end up owing money due to someone else’s negligent behavior.

If you or a loved one has been injured in a motorcycle accident, the attorneys at Flora Templeton Stuart Accidents Injury Lawyers are here to help. We understand that you may be facing expensive medical bills or are unable to earn a living due to your injuries, which is why our team is on standby to assist our Monroe County clients. Contact us at 866-583-4915 to schedule your free case evaluation and discuss your case with an experienced Monroe County  motorcycle accident lawyer.

Pedestrian Accidents

Thousands of people rely on sidewalks, crosswalks, and traffic signals for protection on their commute to work, when running errands, or just to get some fresh air. Sadly, these safety measures don’t always prevent negligent drivers from striking a pedestrian. Not only is it difficult for pedestrians to protect themselves from these kinds of accidents, but without a physical barrier between your body and the vehicle, the injuries can be catastrophic.

Determining Fault in a Pedestrian Accident

When an accident occurs between a vehicle and a pedestrian, determining fault can be challenging. Drivers must exercise reasonable care to avoid collision with both other vehicles and pedestrians. Whenever a driver engages in any type of negligent, reckless, or careless behavior behind the wheel and strikes a pedestrian, the victim has a right to be compensated. Some examples of negligent or careless behavior include:

  • Texting while driving
  • Ignoring crossing signals or zone signs
  • Speeding through crosswalks
  • Driving while intoxicated
  • Misjudging road or weather conditions
  • Failing to signal

Our Monroe County pedestrian accidents lawyers will perform a thorough investigation to uncover any negligent behavior that contributed to the accident. By proving that the driver engaged in some type of negligent behavior, we can build a strong case and pursue maximum compensation for injured pedestrians. We will negotiate with insurance adjusters on your behalf to ensure that you receive fair compensation for your injuries and losses.

If you or a loved one has been injured by a negligent driver, speak with an experienced attorney at Flora Templeton Stuart Accident Injury Lawyers today for a free case evaluation.

When Insurance Pays In A Car Accident

Several types of insurance coverage that will pay if you’re injured in an automobile collision:

Personal Injury Protection: The vehicle you are in is the primary coverage for payment of Personal Injury Protection (PIP) in Kentucky. PIP has minimal limits of $10,000 and pays medical expenses, lost income, home care, and even a portion of funeral expenses. Kentucky automobile accident lawyers reserve these benefits so medical bills and lost wages will get paid. PIP is repaid by the party at fault.

Liability: The at-fault driver pays for injuries caused to another through their liability policy, which in Kentucky has a minimum policy of $25,000 per person / $50,000 per accident and a maximum can be in the millions with a commercial insurance policy.

Uninsured Motorist: If the driver at fault did not have insurance you can collect on your uninsured motorist’s coverage on your own insurance policy.

Underinsured Motorist: If the at-fault driver of the vehicle had insurance but not enough or your injuries are greater than that amount you can collect on underinsured motorists. Flora Templeton Stuart will make sure all underinsured policies are uncovered for maximum recovery.

How We Prove Negligence in Your Auto Accident Case

Negligence in car accidents typically involves a driver failing to exercise reasonable care. As Kentucky car crash lawyers, before we can take action against the liable party, we need to prove that their negligence led to the accident. We do this by establishing the following elements of negligence:

Duty of care: The at-fault party had a responsibility to keep you safe by following all traffic laws.

Breach of duty: The at-fault party breached their duty of care, instead acting negligently.

Causation: The at-fault party’s actions or inactions caused you to suffer an accident and injuries.

Damages: You suffered damages, such as pain and suffering and property damage, because of the at-fault party’s negligence.

Our team will gather evidence to prove negligence, including police reports, witness statements, and surveillance footage.

Kentucky and Tennessee Car Accident Laws

Under the “no-fault” car insurance system in Kentucky, drivers are required to carry a minimum of $10,000 in Personal Injury Protection (PIP) insurance. Regardless of who causes the accident, PIP covers medical expenses and lost wages. However, if you’re in an accident, you can opt out of the no-fault system to pursue auto injury claims against the at-fault driver and possibly receive more vehicle accident compensation.

Statute of Limitations in Kentucky and Tennessee

In vehicle accidents, there is a limited amount of time to sue. In Kentucky, you have two years after the wreck to sue which can be extended with PIP benefits being paid, as per Ky. Rev. Stat. § 304.39-230(6). In Tennessee, you only have one year to file an auto accident lawsuit. Time limits for minors start when they turn 18. The Statute of Limitations for Wrongful Death cases is governed by KRS 413.140.
