Determining Fault in Tennessee Motorcycle Accidents

The modified comparative fault laws allow for a judge or jury to assign a percentage of fault for each party involved in the accident. In this scenario, the total amount of compensation received could be reduced by 20% due to your percentage of fault in the accident. Therefore, if you were awarded $50,000 as compensation, you would only receive 20% of the total, leaving you with $40,000.

One exception to this rule is known as the 50 percent rule. Under this rule, accident victims may only collect damages if their percentage of fault for the accident is 49 percent or less. If they primarily responsibility for the accident, then they are not eligible to receive any damages for the accident.
