Grandmother Recovers in Wrongful Death Case
When you or a loved one is injured due to another person’s improper conduct it can be a very stressful experience and if someone you love is killed in this way it can be traumatizing. One such Kentucky lawsuit has finally come to a close after more than 15 years.
In 1996, then 18 year old Lebron Gaither of Lebanon, Kentucky was murdered. Prior to his death, Gaither worked as a confidential informant for the Kentucky State Police. Specifically, he wore a wire while purchasing drugs in an undercover operation. After doing this, he testified in an indictment in Marion County Court. At this point, Lebron’s identity was revealed and a known drug dealer, Jason Noel, found and killed him. The drug dealer was caught, convicted and has been sentenced to life in prison.
After his death, Lebron’s grandmother, Virginia Gaither, brought a wrongful death lawsuit against the Kentucky State Police. She claimed that the police were liable for her grandson’s death because they acted improperly when they continued to use him as an informant even after his identity was revealed. She has said that the police did not take the appropriate measures to protect Lebron. The trial court found in her favor and awarded her $168,000 in damages. The case was then appealed and the decision was reversed. But, Virginia persisted and appealed the case to the Kentucky Supreme Court. This court found in her favor again and awarded her $148,000. Although Virginia insists that she was more interested in justice for her grandson than the monetary award, she has said that she will use the money to buy Lebron a headstone.
