Daughter of Man Run Down By Police Cruiser Files Wrongful Death Lawsuit

What type of lawsuit is appropriate when personal injury results in a fatality?

When a person involved in an accident sustains injuries as a result of the negligence of another, the injured party can bring a personal injury lawsuit. While the representatives of an individual who was injured can initiate this type of lawsuit if necessary, it is usually the injured party him or herself who files suit. When a person dies as a result of personal injuries, however, a different type of lawsuit must be filed. These cases, known as wrongful death lawsuits, are usually brought by a representative of the deceased, such as the executor of his or her estate. A case recently filed in Lincoln County, Kentucky is a good example of a wrongful death suit.

In January of 2014, 69 year-old Howard Robbins was walking down a Stanford roadway when he was struck by a police cruiser. It is alleged that the officer operating the cruiser was traveling at a high rate of speed at this time. Robbins was seriously injured and pronounced dead at a local hospital later that evening. His daughter, Tiffany Blanton, has filed a lawsuit for the death of her father not only against the operating officer, Travis Richardson, but also against the police chief in charge, the mayor of the city of Stanford and the city itself.

Blanton claims that Richardson was driving negligently as he was operating at a high rate of speed even though he was not responding to an emergency. She also argues that the police chief was negligent in his training and supervision of Richardson and that the mayor continued Richardson’s employment even though he was aware or Richardson’s tendency to operate his cruiser negligently. Her claims against the city include vicarious liability, which means that an employer is responsible for the negligence of the employee. Although Richardson was fired after the incident, Blanton does not consider this sufficient. She is seeking money damages for the loss of her father, the loss of his future earnings and expenses related to his death.
